Terms of Service

These Terms of Service ("Terms") govern your use of the realgoals website and application ("Service"), operated by Voras Digital, MB, a limited partnership (maža bendrija) registered in the Republic of Lithuania (company code: 307551703) ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or 13 in the United States) to use the Service. By using the Service, you represent that you meet this age requirement. If you are under the age of legal majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

3. Description of the Service

realgoals is an AI-powered goal tracking and adaptive planning service. It connects to your calendar, builds a personalized roadmap around your real availability, and automatically replans when your schedule changes. The Service uses Google Gemini for AI-powered plan generation.

4. Free Trial & Subscription

• We offer a 7-day trial for $1. After the trial period, your subscription automatically converts to the annual plan at $49/year (introductory offer for the first year) unless you cancel before the trial ends.
• Subscription fees are billed annually in advance. Prices are in US dollars.
• We reserve the right to change pricing with reasonable notice. Price changes will not affect your current billing period.

5. Cancellation & Refunds

• You may cancel your subscription at any time through your account settings or by emailing [email protected].
• If you cancel during the 7-day trial, you will not be charged the annual fee.
• If you cancel after the trial has ended, your access continues until the end of your current billing period. We do not provide prorated refunds for partial billing periods.
• EU/EEA consumers: Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a distance contract within 14 days of purchase without giving any reason. To exercise this right, contact us at [email protected] within 14 days of your purchase. If you have actively used the Service during the withdrawal period, we may charge a proportionate amount for the service provided.

6. Calendar Data & Permissions

• To use the Service, you grant us permission to access your calendar data (e.g., via Google Calendar) for the purpose of building and adapting your plans.
• We only access the data necessary to provide the Service, as described in our Privacy Policy.
• You may revoke calendar access at any time through your calendar provider's settings. This may limit or disable certain features of the Service.

7. AI-Generated Content

• The Service uses artificial intelligence (Google Gemini) to generate plans, schedules, and recommendations. These are suggestions only and do not constitute professional advice of any kind (medical, financial, legal, fitness, or otherwise).
• AI outputs may be inaccurate, incomplete, or unsuitable for your specific situation. You are solely responsible for evaluating and acting on any AI-generated content.
• We do not guarantee specific outcomes or results from following AI-generated plans.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission.
• Resell, sublicense, or redistribute the Service.
• Upload or transmit malicious code, viruses, or harmful content.

We reserve the right to suspend or terminate your account for violation of these Terms.

9. Intellectual Property

• The Service, including its design, code, branding, and content (excluding user-generated content), is owned by Voras Digital, MB and protected by applicable intellectual property laws.
• You retain ownership of your personal data and any content you create within the Service (goals, notes, etc.).
• You grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service.

10. Availability & Modifications

• We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that negatively affect paying subscribers, we will provide at least 30 days' notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

EU/EEA consumers: Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be limited or excluded under applicable EU or member state law, including mandatory consumer protection rights.

12. Indemnification

You agree to indemnify and hold harmless Voras Digital, MB, its representatives, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms. This section does not apply to EU/EEA consumers to the extent prohibited by mandatory consumer protection law.

13. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law provisions.
• Any disputes shall be resolved by the competent courts of the Republic of Lithuania, unless mandatory consumer protection law in your jurisdiction provides otherwise.
• EU consumers: You may also use the European Commission's Online Dispute Resolution (ODR) platform for alternative dispute resolution.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For material changes, we will notify you by email with reasonable notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
